Terms of Service

These Terms of Service ("Terms") govern your use of the Vital Core Recovery website at vitalcorerecovery.com (the "Site") and the services offered by Vital Core Recovery LLC ("VCR," "we," "us," or "our"). By using the Site or booking services, you agree to these Terms.

1. Nature of Services

Vital Core Recovery provides non-medical wellness and recovery services, including the Vital Scan (a 90-second, 12-marker wellness assessment), self-guided recovery sessions, neuromuscular sessions, and memberships. We do not provide medical diagnosis, treatment, or rehabilitation, and our services are not a substitute for licensed medical care. The Vital Scan is a wellness assessment tool, not a medical device, and is not intended to diagnose, treat, cure, or prevent any disease or medical condition. Always consult your physician before beginning any new wellness or recovery program.

2. Eligibility

You must be at least 18 years old to book services or maintain a membership on your own account. Minors may participate only with parental or legal-guardian consent, including in-person authorization at the studio and a signed waiver.

3. Use of the Website

You agree to use the Site in compliance with all applicable laws and not to interfere with Site operations, attempt unauthorized access, or misuse any content, feature, or account.

4. Bookings, Payments & Memberships

All pricing is in U.S. dollars. Payments are processed through third-party providers, and by submitting payment you agree to the applicable provider's terms in addition to these Terms.

Memberships are billed monthly and auto-renew each month until cancelled in accordance with your plan. You may cancel or change tiers by contacting us at info@vitalcorerecovery.com or at the studio, subject to any commitment terms disclosed at sign-up (for example, a 3-month commit associated with a launch credit).

Session cancellations are governed by our stated cancellation policy — currently 12 hours' notice for self-serve cancellation. Inside that window, contact the studio and we will do our best to accommodate.

Gift cards purchased through our website do not expire and are redeemable only for the services or credits described on the card.

5. Waiver & Assumption of Risk

Participation in recovery and wellness services involves inherent risks, including soreness, fatigue, muscle discomfort, and minor bruising. You voluntarily assume these risks when you choose to use our services. Before your first session, you will complete a client waiver acknowledging these risks. Certain services (including Performance and Vital tier neuromuscular sessions) require an additional pre-screen with our Lead Registered Nurse.

6. No Medical Relationship

Your use of our services does not create a doctor-patient relationship. Our staff do not diagnose or treat medical conditions and will refer you to a qualified medical provider if anything you share warrants medical attention.

7. Intellectual Property

All content on the Site — including the Vital Core Recovery name, logo, protocols, written content, images, and videos — is the property of Vital Core Recovery or its licensors and is protected by copyright, trademark, and other laws. You may not reproduce, distribute, or create derivative works from Site content without our prior written permission.

8. Third-Party Links & Services

The Site may link to or embed content from third-party services, including scheduling, payment, gift-card checkout, and analytics providers. We are not responsible for the content or practices of these third-party services. Your use of them is governed by their own terms.

9. Disclaimer of Warranties

The Site and our services are provided on an "as is" and "as available" basis. We disclaim all warranties, express or implied, including warranties of accuracy, uninterrupted access, merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee any specific recovery, performance, or wellness outcome.

10. Limitation of Liability

To the maximum extent permitted by law, Vital Core Recovery, its owners, employees, and contractors will not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to your use of the Site or participation in our services. Our total liability for any claim will not exceed the amount you paid to us in the 12 months before the claim arose.

11. Indemnification

You agree to indemnify and hold harmless Vital Core Recovery, its owners, employees, and contractors from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Site, your participation in our services, or your violation of these Terms.

12. Privacy

Our collection and use of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

13. SMS / Text Messaging (VCR Alerts)

The VCR Alerts program sends appointment confirmations, reminders, membership updates, and — only if you separately opt in — promotional messages. Message frequency varies; message and data rates may apply. Consent is voluntary and not required to purchase any goods or services. You may opt out at any time by replying STOP to any message, or get help by replying HELP. See our Privacy Policy for more detail, including our commitment that no mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

14. Changes to These Terms

We may update these Terms at any time. When we do, we will update the effective date at the top of this page. Your continued use of the Site after we post changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the State of Minnesota, without regard to its conflict-of-laws principles. You agree to the exclusive jurisdiction of the state and federal courts located in Hennepin County, Minnesota, for any dispute arising out of or related to these Terms.
